Ireland AM Giveaway Terms and Conditions

Running from 30th of September to 18th of October (the “Competition”). 

PROMOTER 

The promoter of the Competition is Virgin Media Television Limited, registered in Ireland under company number 272612 and having its registered office at Macken House, 39/40 Mayor Street Upper, Dublin 1, D01 C9W8, Ireland (“we”, “us” or “our”).  

The Competition will run on Ireland AM and may be promoted across Virgin Media Television channels and their associated websites and social media channels. 

DURATION 

The Competition runs from the Start Date to the End Date (“Entry Period”). 

The Competition will consist of daily competition rounds, each a “Round”. The closing time for entries and the time of the call for each Round will be announced on air and may also be published on our website and social media channels. 

Entries received before the Start Date or after the End Date will be invalid, but the persons submitting those entries may still be charged and we will have no obligation to refund such charges, except where required by law. We may make on-air announcements regarding the Competition at any time throughout each day during the broadcast schedule. 

The Entry Period and the closing time for each Round are final and are not affected by the time of broadcast of announcements regarding the Competition, which may be delayed. 

HOW TO ENTER AND COSTS 

Entrants can enter by sending the keyword WIN by SMS to 57001 during the applicable entry period for a Round. 

A single SMS message costs €2.50 from the Republic of Ireland plus the entrant’s standard network rate. If the message does not contain the correct keyword, is not sent to the correct number or is received outside the applicable Entry Period, it will not be entered. Entrants will receive an automated SMS response confirming receipt of their entry. Delivery of this message may be delayed at peak times. 

An SMS received after a Round has closed and before the next Round opens will not be entered into either Round. The sender will receive a free service message advising that the Competition is closed. 

Submission of a valid entry does not entitle an entrant to the Prize. To win the Prize, an entrant must be randomly selected, answer our telephone call within the period specified below and correctly answer the competition question within the permitted time. Entrants are responsible for all costs associated with entering the Competition. Entrants must have permission from the bill payer before entering the Competition. 

We are not responsible for any mobile network or technical issue an entrant may experience which may delay or prevent their participation or cause them not to win the Competition.

THE DRAW AND WINNING THE PRIZE 

During each Round, the prize amount (“Prize”) will be announced on air. 

Unless a higher amount applies because of a rollover, the Prize available for each daily Round will be €1,000. 

We may announce the Prize at any time during the Entry Period. We may also advertise the Prize on Virgin Media Television websites and social media channels, through permitted SMS messages and through any other appropriate medium. After the closing of each Round, we will conduct a draw using Fonix’s Campaign Manager or Winner Picker platform. The draw will involve randomly selecting three entrants from all valid entries for that Round (“Draw”). The three selected entrants will be placed in the order determined by the Draw. 

We will call the first selected entrant on the telephone number used to enter. If the first selected entrant does not answer their phone within five rings, we will call the second selected entrant. If the second selected entrant does not answer their phone within five rings, we will call the third selected entrant. 

No more than three selected entrants will be called during an ordinary Round. The five rings will be judged according to our audio. For the avoidance of doubt, the sound of a “ring ring” will count as one ring, not two. 

If a selected entrant answers the call within five rings, they will be asked a competition question live on air. 

The selected entrant must give a correct answer within five seconds of being asked the question. If the selected entrant correctly answers the question within the permitted time, they will win the Prize. We may ask the selected entrant to repeat or confirm an answer given within the five-second period. 

If there is any doubt as to whether the selected entrant correctly answered the question, answered within the permitted time or should otherwise be awarded the Prize, we may refer the decision to an off-air adjudicator. The adjudicator may review the audio recording with reference to these Terms. 

If a selected entrant answers the telephone call but: 

  • incorrectly answers the question; 
  • fails to give a correct answer within five seconds; 
  • fails to say anything; 
  • gives an answer that cannot reasonably be understood; 
  • receives assistance from another person; or 
  • is disconnected for any reason outside our reasonable control, 

they will not win the Round, no other entrant will be called during that Round and the Prize will roll over to the following Round.  

For the avoidance of doubt, a selected entrant will not be able to win the Prize if the call goes to voicemail or if they fail to answer the telephone within five rings. We will not be required to leave a voicemail message, send an SMS, call the same selected entrant again or attempt to contact them through another method. 

If a call goes to voicemail, we may edit any audio of the call to protect the identity and personal information of the entrant. If none of the three selected entrants answers the call within the required period, there will be no winner of that Round and the Prize will roll over to the following Round. When there is a winner of a Round, a new Prize will be announced on air. The pool of entries used for the winning Round will not be valid for future Rounds or competitions. Persons wishing to participate in a later Round will need to enter again. 

If there is no winner of a Round, the Prize will roll over to the following Round, but entries submitted for that Round will not carry forward. A person wishing to participate in the following Round must submit a new entry. 

The final Round, and any other Round we nominate, may be designated as a “guaranteed win round”. 

For each guaranteed win round, if none of the selected entrants answers within the required period and correctly answers the question, we will conduct a further Draw. That process will be repeated until an eligible selected entrant answers within the required period and correctly answers the question. 

ENTRANT RESTRICTIONS 

The Competition is open only to persons aged 18 or over who: 

  1. have a permanent residential address in the Republic of Ireland; 
  1. have a mobile telephone number registered with a mobile network provider in the Republic of Ireland; 
  1. have permission from the bill payer to use the relevant mobile telephone to enter; 
  1. are not an employee, contractor or agent of Virgin Media Television Limited, Virgin Media Ireland Limited, Fonix, any prize-fulfilment provider or any other company involved in operating the Competition; 
  1. are not an immediate family member, including a live-in partner, or household member of a person described in paragraph (d); and 
  1. if the Competition has an associated sponsor or commercial partner, are not an employee or immediate family member, including a live-in partner, of an employee of that sponsor or commercial partner. 

An entrant may submit a maximum of 12 entries in each Round, including any additional entries obtained through the Optional Additional-Entry Offer. Entries in excess of that limit will not be accepted. An entrant’s mobile network provider may impose a lower limit on the number of entries that may be submitted. 

A person who has won a Virgin Media Television competition during the previous six months is not eligible to win the Competition. If an entry submitted by an ineligible previous winner is selected, that entry will be rejected and we may proceed to the next selected eligible entrant. All entries submitted using that person’s mobile telephone number will be treated as ineligible. 

Each SMS entry will be charged separately. Entrants are responsible for managing the number and cost of entries they submit and should not enter where doing so may cause them financial difficulty. The use of automated-entry software or any other mechanical or electronic means that permits repeated or multiple simultaneous entries is prohibited. 

All entrants must enter on their own behalf and may not enter on behalf of another person. It is each entrant’s responsibility to ensure that they are available to answer their telephone at the relevant time and date. 

No refund will be provided if an entrant enters the Competition but is unavailable or unable to answer the telephone call. Entrants are responsible for the safekeeping and full working order of their telephone. 

No refund will be provided where an entrant is unable to answer because of the loss or malfunction of their telephone, lack of network coverage, call-filtering settings applying to unsaved or withheld numbers, or another matter outside our reasonable control. Use of a false name, address, age or other information will result in disqualification. We may require proof of an entrant’s age, identity, residential address, telephone number and bill-payer permission before awarding the Prize. 

If we become aware, after the Prize has been awarded but before it has been paid, that an entrant was in breach of these Terms, we may withdraw the Prize. If we become aware, after the Prize has been paid, that the entrant was in breach of these Terms, we may request that the entrant repay the value of the Prize. Upon receipt of that request, the entrant must promptly repay the relevant amount. 

In either case, we will have no obligation to conduct a further Draw or award the Prize to another person. We may exclude individuals who breach these Terms from entering this Competition or future Virgin Media Television competitions. 

WINNER ANNOUNCEMENT 

Selected entrants will be required to talk to the presenter or programming team live on air or off air, and the call may be recorded. Due to programming, editorial or technical requirements, the call may not be broadcast or may be broadcast after a delay. 

By entering the Competition, entrants agree to: 

  1. being called on the mobile telephone number used to enter; 
  1. the competition call being recorded; 
  1. the call being broadcast live or as a recording;  
  1. the call, or an edited extract from it, together with their first name, voice and general location, being published on Virgin Media Television’s websites and social-media channels; and 
  1. if they win, their first name and general location being announced on air. 

Except for the uses expressly described above, selected entrants will not be required to participate in additional publicity without their agreement. 

PRIZE DETAILS 

The Prize is a monetary amount which will be paid to the winner by bank transfer through our prize-fulfilment provider. 

Payment of the Prize is subject to the winner providing: 

  • satisfactory proof of identity and age; 
  • proof of their residential address; 
  • confirmation of the mobile telephone number used to enter; 
  • bank-account details in the winner’s own name; and 
  • any other personal information reasonably required to verify eligibility and complete lawful compliance checks. 

The winner must provide the requested information and satisfy the relevant verification and compliance checks within 14 calendar days of being contacted. Payment of the Prize will be made within 28 days after the required information has been received and verified. 

If a winner does not provide the required information within 14 calendar days, cannot establish their eligibility or does not satisfy the relevant verification and compliance checks, they will forfeit the Prize. 

If a Prize is forfeited, we may conduct a further Draw or carry the Prize into another Round. The Prize is non-transferable and no interest will be payable on it. The winner is responsible for any personal tax liability arising from receipt of the Prize. 

OUR LIABILITY 

We make no representation or warranty in relation to the Competition and to the maximum extent permitted by law we shall have no liability in relation to it. All implied conditions, warranties and representations are excluded.  

We will not be liable for any loss or damage arising from: 

  • an entrant’s failure to comply with these Terms; 
  • a mobile network, telecommunications or technical failure outside our reasonable control; 
  • an invalid, late, unsuccessful or incorrectly formatted entry; 
  • an entrant’s inability to answer the telephone; 
  • incorrect information provided by an entrant; or 
  • an event outside our reasonable control. 

GENERAL 

If the Competition is unable to run as planned, or if the Prize cannot be awarded or paid, because of an event outside our reasonable control, including technical failure, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or regulatory intervention, we may cancel, terminate, modify, extend or suspend the Competition. 

Selected entrants will not be put through to speak on air if we reasonably believe that they are driving unlawfully, intoxicated, likely to swear or otherwise likely to offend our audience. 

While on air, selected entrants must not use foul, threatening, discriminatory or offensive language or say or do anything defamatory or unlawful. Selected entrants must not say or do anything that could damage our reputation, the reputation of our partners or cause harm to us, our staff, our partners or our audience. 

Failure to comply may result in disqualification and, if the entrant has won the Prize, forfeiture of the Prize. We will only accept entries that comply with these Terms. We may disqualify an entrant if we know or reasonably suspect that they have breached them. 

We may disqualify a person from the Competition and future Virgin Media Television competitions if we reasonably consider that their conduct is contrary to the spirit or intention of the Competition, including where they are abusive, rude or offensive to our staff or service providers. In the event of fraud, abuse or an error affecting the proper operation of the Competition, we may terminate or suspend the Competition, amend these Terms or disqualify an entrant. 

All decisions relating to the Competition and awarding of the Prize will be made by reference to these Terms and will be final, except in the case of manifest error or where an entrant has a statutory right to challenge the decision. By entering the Competition, entrants agree to be bound by these Terms. 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The Competition and these Terms are governed by Irish law and are subject to the jurisdiction of the Irish courts, without prejudice to any mandatory rights available to consumers. 

Optional Additional-Entry Offer 

Following a valid entry, an entrant may be offered the opportunity to receive two additional entries for a further charge of €2.50 plus the entrant’s standard network rate. Participation in this offer is optional. The offer may not be available during every Round and may be withdrawn or suspended at any time. Any additional entries purchased under the offer will be subject to these Terms, including the maximum of 12 entries per Round.

DATA PROTECTION 

When entering the Competition, entrants are added to our customer database and may receive promotional SMS messages. These messages will be free of charge. Entrants may opt out of receiving such messages at any time by texting OUT to 57001. This text will be charged as a standard network rate message. Entrants may also opt out of receiving such messages by visiting https://oo.fonix.com/vm and entering their mobile number. Opt-out requests submitted through the online facility may take up to 24 hours to take effect. 

If entrants do not wish to receive promotional SMS messages, they will need to opt out after each Round in which they enter the Competition. Entrants’ personal data will, regardless of whether they opt out, continue to be used to process their entries.
